What is the name of your state? nm

when its time to go court, if ends up going to court. I know you need evidence to prove if one parent has endangered the child or threatened bodly harm to the child. Would an eye witness be sufficent enough. For example my ex left me a message stating that he was going to kill me take my daughter and I let his mother listen to the message, would her testimony be good enough? I busted him with illegal substances where he was living at the time would I told his family about it and through him out. Would my word mean anything to the courts?

Did you save the message he left you? You or someone else testifying to what he said in the message isn't likely to be enough. Nor is YOUR "busting" him for illegal substances - a conviction would go further.

You might try stating in court that he has a substance abuse problem and has threatened your life. It will only hold up if he is stupid enough to admit it in court. You'd be surprised at what people admit in court, I was.. I had no physical proof that my child mother was doing drugs. I stated that I had walked in on her and she admited to it. Doesn't hurt to try, just keep yourself dignified and respectful.
