court was in alabama,my stepchildrens mom ran off may 27th and has not returned,she has had phone contact with the 3 minor children and their dad as well as myself,she instructed us to keep the kids and send them to school this coming up year,we record all phone conversations with her we filed for custody may 5th and went to court july 12th the judge awarded us custody now mom says she was never notified and appealed it we go to court again tomorrow,thing is it's not mom not wanting us to have the children it's grandma who thinks they are hers the july 12th court the judge said if so delegated by the mother grandma can have 2nd and 4th weekends visitation the kids do not want to go to grandmas they are scared of her for some reason,the kids were living mostly with grandma before mom ran off n left them with us i was just curious about nething that might help us in court tomorrow.grandma has worked in the tax assessors office in same courthouse for 20 years could that make a difference in this ruling ? thank you in advance for all info,[email protected]

Wow, talk about a run-on sentence. If the court orders visitation to Mom, the kids go whether they feel like it or not. If she sends them to grandma's on her time - the kids go whether they feel like it or not. If the court orders visitation to grandma, then they go to grandma's whether they feel like it or not.

Well, then that shouldn't be an issue, right? But if the judge decides that they should have visitation with their grandmother despite Mom's disagreement with it, then they'll be going to visit grandma.

Noone can tell you what the judge will or won't decide.

thank you for reply,we have just heard so many different things about grandparents not having rights unless the parent gives it to them.

In a lot of cases that is true however they also go by the best intrests of the child and the prior relationship with the child. For example if my children's bio grandparent sued for visitation she wouldn't receive them as she's not seen them in over 3 years by her choice while having the ability to do so. Your step-child's grandparent on the other hand had the child living in her home for most of their life and a continuing relationship would most likely be beneficial to the child. IMO I still don't think it gives them the right to HAVE legal visitation but I'm not a judge.
