What is the name of your state (only U.S. law)? Iowa
When my was 14, he was committed to a psychiatric facility (not by me). During his time there, he was put into "a hold" and subsequently was arrested for assaulting a staff member during this incident. By the way, I was a witness to this incident, so it's not a case of "he said, she said". Also, my son is high functioning autistic, if that's a factor.
At any rate, he was acquitted and not adjudicated delinquent. It was a psychiatric facility for crying out loud.
After he was discharged from this facility, he went on to finish high school (with honors, thank you). We moved out of state (for other reasons) and he's led an exemplary life since then.
Here's my question: aren't juvenile records supposed to be sealed? The state of Iowa has a court website, where you can look up virtually anyone's court record, from improper lane changes to homicide.
My son's assault case is included on this website.
One of the involved parties listed is his psychiatrist.
A. How can we get this removed?
B. Isn't mentioning his psychiatrist a HIPPAA violation?
