Coverage of towing cost-Revised

houston, texas

i recently was in an automobile accident and had minor head and leg injuries. in the middle of all the confusion my car was already on the back of tow truck. the tow truck driver said i had to sign the form in order to tow the car. i read the form, which stated $125 towing service and at the bottom were i signed it said that they were not liable for any towing damages. I gave the form back to him and he ask me were i wanted the car to go and repeatedly ask my if i had insurance (the car does have insurance but i am excluded). minutes later he gave me the yellow copy. the next day i revised it and it now said 125 tow fee, 125 roll over fee, 125 transfer fee. when i went to go get the car it was 375 in towing services, another 125 tranfer fee and a day in storage fee. Now i have a bill for $537 in towing charges and said i have to pay because i signed a contract. The paper that i signed only states the price and that they were not liable for any damage while the car was in tow .
is there anything i can do. Thank you.

My response:

Ask again. It was probably for towing AND storage. Yes, you're on the hook.

Depending on the conditions of the 'contract', there is probably little you can do AFTER the fact (these circumstances should have been reviewed before agreement).

However, I would be very interested in two things:
1) How did a 'normal' towing bill get to become $537.00??
2) Was this an 'agreed' tow (no statutory pricing) or a 'non-consensual' tow (city of Houston pricing)??

If you feel that you have been overpriced, you can call HPD's Tow Line at (713) 308-8580 or the Harris County Tow Line at (713) 755-6042.
Or, you can take the tow company to small claims court.
