CP moving after NCP Leaves

What is the name of your state (only U.S. law)? California

Good morning everyone. Things have been going well for myself and my children. I have even gotten my oldest on the road to having a relationship with his father, and his father to accept the fact that he did do wrong w/ his son.

My ex is moving on Thursday to Virginia, orders from the military. I just have a few questions regarding what needs to be done. We haven't set up a parenting plan yet for two reasons, one, he doesn't have a place to live yet and two, he does not know what his schedule is going to be yet in regards to deployments/training etc. I have suggested that he flies out here for a week in the summer to visit and he can stay with friends, he has not responded to that because he doesn't know his schedule yet.

His pay will be going down by roughly 500/month due to location, but since his parenting time will also be going down, I suggested just leaving the child support as is because it will come out roughly the same. He has agreed to this. Neither of us have filed anything with the courts in regards to this or to his moving. Do we need to file anything if there is no change in CS? Obviously he needs to notify the court of his moving, which he has not done but that is not my concern as of yet.
I am going to be looking at moving out of California (not my home state and personally just don't like it) after the end of the 09-10 school year. I would move sooner, but the youngest really needs to start Kindergarden in the fall and the three states that I am looking at moving to, she will miss the cutoff date. When I do decide to move, is there anything that would prevent me from moving out of the state? His orders are for 3 yrs, so the possibility of him moving back to California in the next year is slim to none.

Yes. If you are moving to Alaska, Hawaii or another country. Pretty much any other state would be moving closer to dad but those places mentioned above could complicate and lessen his visitation even more so. Especially since the children are not old enough to fly unattended. And you are not going to get a direct flight from Hawaii to Virginia. And most likely not even Alaska to Virginia. Have you considered moving to Virginia?
 
I have considered moving to Virginia, but its not on the top of my list of choices. I grew up in Illinois and Kentucky, and have family in Arizona and Florida, so those are my first choices. The chances of him staying in Virginia after the 3yrs are up are pretty slim, so he would be moving again. My goal is to move the kids closer to their Dad, somewhere with good schoos, somewhere that I can pay 1000 in rent and get a decent house rather than 1400 in rent and get a tiny 2br apartment, and live where there are 4 seasons. Oviously this all centers around me finding a job where all these requirements are met. I am already in a Federal job, so I'm just biding my time and then I will apply to jobs within these areas and see what comes of it.

Quite frankly I don't see a court not allowing the move and I don't see dad arguing with the move if he gets a chance at more time with the children.

Just a side note, but there are only two seasons here in Florida: Construction and hurricane. :D:D

Besides good schools and all that other stuff, you might want to consider the child support systems, etc of the state you will be moving to, because neither of you will then be residing in California.
