CPS wants to take child if...

This thread has nothing to do with mine. I am asking this for my neice, Her husband has been battling depression for a while and said he was going to kill himself and had a gun, the cops were called and he was taken to jail and charged with Crimanal threatning. (even though it was his own life he threatened) now CPS has told the mother that if the father does not sign over his parental right, the mother will lose her child, this does not sound right to me, and her husband who is still in jail, has been for a month is getting some help, can they do this? Just take the child because he wont sign those papers?:confused:

1. Commiting suicide or even threatening to is against the law.

2. Yeppers they sure can.

They can but it seems a bit extreme to me if he was only threatening his own life and not anyone else's. CPS doesn't normally insist on terminating parental rights unless the parent doesn't get help or adhere to the case plan.

Also, OP's neice has no control over whether or not her husband voluntarily agrees to terminate his parental rights. I can see them threatening to take the child from her if she allows him around the child...but if OP has the story correct they are threatening to take the child over something she can't control.

Either there has to be more to this story, or someone is misunderstanding exactly what CPS has said.

It seem to be happening a lot lately....parents killing themselves and their children....CPS doesn't want this to happen to you friends children. Tell your friend to comply with the order....If the husband is getting help, after a period of time and an okay from his doctor, he can request his rights be restored...

Have her talk to an attorney about the situation.

Me thinks there is more to the story.

Were kids at the house when he did this?

What happened when the police got there? was there a standoff or did he just give up peacefully?

Get a copy of the police report and see what they wrote on it. If he told the police he might hurt someone else also they probably called CPS. If the kids were in the home when he threatened to take his own life this would also cause CPS to want him to give up his rights.

In light of the recent court cases and happening involving CPS and the mistsakes that they have made in the last 2 years the are getting extremely tight in the way they handle things.
