Hello everyone, recently my little brother was In the hospital and was drug tested in the hospital and tested positive for marijuana. Well its been about 2 weeks ago and now cps has called my father saying they are going to drug test him. Do they have the right to drug test him. I live in California

Too many pro-nouns make it hard to follow who's, who. Who does CPS want to test, your father or brother again? It there an open CPS case? How old is your brother and why was/is he in the hospital? Is the case in Cali? Is there a reason that your father isn't posting for himself?

Thank you for replying. Cps wants to test my little brother, and he is 15. He crashed a dirt bike which resulted in him staying in the hospital. I do not know if there is an open case or not and I think my dad just dosnt want to go against cps

Apparently he tested positive for pot after an accident while he was driving. So, yes. There is a reason for it. Please have your Dad join, under his own user name. It would be easier to talk directly to him. Thank You.

While CPS cannot - on its own - compel a further drug test from your brother, they CAN move to take temporary custody if they have sufficient cause. Additionally, if your brother tested positive for pot and there is good cause to believe he was operating his dirt bike while impaired at the time of the crash, he can be charged with DUI.
