I sold a rug on Craig's list about two weeks ago to a buyer who now is threatening to sue me in small claims if I don't refund her money. She is claiming that the rug has a "horrible smell" that infuses her whole house and that she has sought the advice of a rug specialist who has told her that the smell is from the latex backing degrading (normal as a rug ages) and that cleaning would not help the "problem". In the 3 years I owned the rug (I bought it new), I never had any odor problems with it, it was absolutely fine. Prior to purchasing the rug from me, she came to visit it and inspected it thoroughly by rolling it out and actually went so far as to say "wow, this is in perfect condition!" -- never did anyone notice any strange smells. Would a claim filed by her stand up in court?
Thanks so much! What is the name of your state?
