I reside in GA and I am desperate for some advice. I have rencently sold my computer on Craig_s list, and the individual who bought it is threatening to sue me. The guy came over to my house inspected the computer and bought it for 800. He is now claiming there is a dent in the computer and I should refund him 250 dollars for his computer, because He claims I sold it to him with the dent in it. The computer left my house in perfect condition. He says that I used the word excellent to describe the condition of the computer in my ad, and he Is going to take me to small claims court for misleading him if i dont give him 250. Not only has he threatened to sue me but he has also threatened to use all of my personal information on the computer to contact the names and number in my address book. I am really lost scared and confused. I am an honest college student who just wanted to sell his power book. PLEASE HELP

Tell him to go ahead and sue you then. He inspected the computer before he handed you the money, I presume. I don't see that he has a valid case. Also tell him that if he uses your personal information to defame you in any manner you will sue HIM. I bet next time you wipe the drive clean before you pass along a used computer, eh?

It would seem to make since that if he inspected the computer for any damages and decided to buy it, that I am in the clear. I dont know what happened to the computer once he took possesion of it. Might I mind you that damages he is claiming are cosmetic ones. I really don_t want to make this assumption, and end up in small claims court with a ruling against me. So if anyone knows the legality of the situation, I COULD REALLY USE THE ADVICE.

He bought the computer as is, he inspected the item, paid you for it. The deal is over.
It is not as if you shipped an unseen item to him. Tell him to pound sand.

Of course, you will probably get a crappy comment on your craig's list seller's listing. Do you care??

Yeah, but he is trying to use my ad against me because I describe the computer to be in excellent condition with no imperfections. This was true, but I don_t know what damages might have occurred once the computer left my dorm. He is claiming that I made these damages. Might I ad he has just sent me an email saying that I will be soon summoned to court if I do not agree to settle with him immediately, and I will surely loose and the record is going straight to my credit report. It sounds crazy and I know that I was honest in the whole situation, but im thinking about giving him the 250 he is asking for to avoid any risks. It was a fair deal but lets get back to the legality of the situation.

We've already told you the legalities of the situation. Twice, no less. You're in college, exercise some reading comprehension skills.

HE inspected the computer before he handed you the money.
You sold it with no warranty, implied or otherwise. In other words it was sold AS-IS. So even if the computer was dented before it left your possession that's just tough titty for the buyer. He had ample opportunity to discover any problems. Tell him to take a long walk off a short pier and block his email. He has NO LEGAL LEG to stand on. Is that clear enough for you?

Yes, he CAN sue you. That doesn't mean he'll win. Anyone can sue anyone for anything. I could sue you for not realizing you've already gotten sound legal advice on this thread twice. I could sue you because your college education doesn't seem to be working. I could sue you for anything I can dream up. Would I win? Of course not, because I have no legal leg to stand on.

If you CHOOSE to be bullied by this guy blowing smoke then that's your problem but not one anyone on a legal forum can help with. For that you need to visit psychiatric forums.
