In my opinion this is a silly question but I have a "worried" friend: She caught her "ex" husband cheating, not to mention several other "things" so she divorced him, but now he is "threatening" to take custody of thier twins girls, because: ok, hold on to your seats on this one.......because of the "type" of music she listens to and that she curses a little or a lot, (depending on your definition). So her question is...."Is this something that can be used against her?" She is a wonderful mother, this is the absolute most absurd thing I have ever heard in my life, but she needed "reassurance" so any info, advice, opinions, would be greatly appreciated. Thanks again.

I'd say she's fine and shouldn't worry. Thats one of the most ridiculous reasons for wanting to change custody that I've ever run across here.

LMMFAO!! Sorry to laugh but she should have left this guy for pure stupidity!! I really do not think she has to worry about anything. That is really the most obsurd thing I have ever heard in my life. It does not affect the way she takes care of her children. I'd say if he took her to court on those grounds alone he'd be laughed outta the building.

As reasons go, it sounds as reasonable as most, which is to say that it is about as petty and nitpicking as most.

My response:

Actually, BCB, it's not so far-fetched as you might think.

An attorney friend had a client who obtained custody from the mother on this issue. Without going into a lot of extraneous detail, it was shown and proven that the woman only listened to music that was about death, dying and / or suicide. After a psychological work-up, the judge agreed that the woman was a potential danger to herself and the child, who was 6 years old and repeating the lyrics - - scaring the bejeebers out of friends, acquaintences and family.

Suffice it to say, custody was changed, and Momma Bear received monitored visitation.

Strange, but true.

No, I'm not at all surprised by a change of custody based upon a psychological evaluation which indicates that a person is a danger to themselves or to others. I've had a few of those myself but more were involuntary committments.

My response:

Yes, we've all had a few clients who either lost custody, or obtained custody, based upon psychological manifestations that we would "normally" experience in such "garden variety" situations; e.g., health and safety issues of the common variety.

However, THIS particular case was decided based upon the music she listened to, and the judge decided not to take any chances. In all other respects, the woman seemed and appeared "normal"; it's just that her child was, according to the shrinks involved, being adversely affected by the lyrics and the judge was, perhaps, erring on the side of safety - - which was his prerogative.

Can you imagine listening to that crap at all, let alone over, and over and over and over again?

I've been telling her that for years. She doesn't listen to "certain" songs around the kids, his gripe is the simple fact that she has this kind of music "around" for them to access. But like I said she is a wonderful mother. Thanks for everyones feedback, she pretty much got my point!
