I have a roommate who is an alcoholic, and we have had it out verbally before. I'd like to know if I'm in my legal right to videotape her with a videocamera in full view? That is, next time we have a fight, I may retrieve my videocamera to document her irrational behavior. I live in California. Am I within my legal rights to do that? We each have signed a rental agreement with a landlord and are living at the same property. Also, can I audiotape her without her knowledge or consent? Thanks. David

Thanks for the response...wiretapping no, videotaping though?

Thanks for the response. I read that link and it contained useful information about California wiretapping laws. What I'm wondering now is...would my roomie have a reasonable expectation of privacy in a public area of the apartment that we are both renting? Moreover, if I turned on the videocamera and said I'm videotaping this, there would be no way for her to deny that she saw the videocamera? What do you think?
