Credit Card Balance Owed by Someone Else

I was recently informed, by my daughter that she had allowed her boyfriend to charge a new transmission for his car on her credit card. (Unbelieveable isn't it) Well naturally they have since broken up and he has stopped making payments against his balance on the credit card. Since they give out credit cards to college students like candy, she didn't even notice the high interest rates attached to this card. Since she has confided in me as to where all of her money is going, I have decided to step in and offer some advise. But...I want to make sure that I give her the right advise. She was smart enough to have him sign a paper indicating that he had used her credit card for a purchase belonging to him and that it was his debt, that was to be repaid my him. Since he has quit paying anything, I was wondering what should be our next course of action. Phone calls she has made have not been responded to and the interest is growing. I am not sure what the "small claims court" limits are on the money amount in our state of Alabama and if this is even the course of action we should take. The amount he owes on the credit card is approx. $2,300. Anyone have any advise on how would be the best way to collect this money?

My response:

Small Claims court is your best, and fastest, bet for resolution of this matter. The Alabama Small Claims maximum jurisdictional amount is $3000. You have a duty to mitigate your ongoing damages, i.e., interest, and therefore, you better file against the boyfriend REAL FAST.
