When a credit card company sets a limit for your card, and you charge up to that amount, and the finance charges put you over that limit, they charge an "over the limit" penalty. So you really don't have the amount available. Does this constitute some sort of fraud on their part? Since you can't actually charge that amount, they are in essence, defrauding you. Anyone have any thoughts on this?

Forget it. It is like a bounced check charge -- if you write a check over your balance the bank charges you to bounce it.

But if you wish to persist, for a second opinion write to the bank's regulator (the Comptroller of the Currency if a National Bank, or the State Banking Department if a state chartered bank).
