What is the name of your state? New York
I have not filed Bankruptcy although am considering it....If I do, one credit card bank will push me toward it.

The one card with the smallest balance has been calling daily, several times a day even though I called them back and told them I had no money until my pension comes at the end of the month. I told them that calling me over and over again is not going to make my pension come any sooner. With all the cards
I have only missed one payment..

They informed me that as long as my card was over the limit because of the non payment, they would be calling....They also wanted me to set up a payment over the phone for the end of the month and I refused....I don't trust them to take only the monthly payment...

So, I guess my question is: Might they take more than the required payment if I set up a payment at the end of the month by phone?

Please do not ever give your bank account information over the phone to any creditor or collection agency - it's an open invitation for them to drain your account of the full amount that you owe them. If you have been paying your original creditor's through your checking account then they already have your banking info anyway.

Since your still dealing with original creditor, they can pretty much get away with about anything. My SIL who used to be in "collections" for Chase Bank stated the Chase's policy was to keep calling multiple times a day until the consumer/debtor answered the phone. Once they make contact, they're done for that day. Then the consumer/debtor goes back into the phone queue for a call the next day, week or month, depending on how deliquent you are. Discover Card is particularly aggresive with in-house collection calls.

Also, if any of your accounts are turned over to collection agencies and you still want to make payments it's considered wise to use money orders.

Be sure if you do reach the stage where filing bankruptcy is your only option to change banks if your current bank provides any loans or credit cards that you will include in your bk. Then the bank will exercise it's right to "offset" and the bank will be able to empty your account of any money owed, up to the full amount your checking ad/or savings accounts.

Thank you ciana24 and others.....I have decided to go ahead and have made an appointment with a lawyer for tomorrow.....

I went to see my lawyer today and everything went well...The court date should be anywhere from four to five weeks.

My lawyer came to the house and took down all info about ten days ago and then sent me the petition to look over...I then made an appointment to go to his office and go over everything and sign the papers and pay his fee. Like I said, everything went well..He explained that the trustee will ask a few yes and no questions and that was that..

I am glad I took this step...I was worrying constantly and was unable to sleep....

I believe turnabout is fair play.
Prehaps call those annoying pissants 5 or 6 times a day just to be sure they got notice of your bk filing!!!! :p :D

LOL..bigun...I am sorely tempted to call them over and over....
I just wonder what they think they are doing if you don't have the money....By calling so many times, it is not going to make the money magically appear.
