I'm looking for any legal advice anyone can give me in this matter. I'd appreciate any input!

I made a purchase from an online merchant for multiple pairs of jeans, the merchant guaranteed their authenticity, and when I received them, they were fake. I notified the merchant and even sent photos of the fake product he sent me, and he agreed, yes they were fake. But he would not give me a refund, he said that he didn't have the money for the refund. Therefore, after a month of trying to send the jeans back to him and receive a refund, and him turning me down everytime, I opened a dispute against him with my credit card company, since I paid for the jeans, with the credit card.

Three months later, the credit card company informed me that the dispute was resolved. I received my refund finally, and no further action was needed on my part. The credit card company did not say to return the product in any way, so I still have fake jeans sitting in a box. Then of course the merchant is now theatening me with legal issues if I don't return the jeans back to him, so he can sell them again and receive his profit. I'm curious as to what I need to do with this situation, if anything. The merchant was not willing to refund my money at all through this process, and now that I finally received my refund, four months later, now he wants the jeans back. For all I'm concerned, why should I work with him now after he wasn't willing to work with me? If I don't return the jeans to him, they're going to be donated to either Goodwill or the Salvation Army, and I'm sure someone's day would be made if they bought a cute pair of brand new jeans for $3.00 or whatever they charge. These jeans, well the authentic ones, retail for $275. They're fake, but still pretty cute! I'm lost on this... any help would be much appreciated! I don't want this guy to just screw his next customer over like he did to me. What he did is illegal according to the jeans company themselves, yes, I even wrote to the company regarding this, and why should I help out someone who's selling illegal merchandise.

Thanks! jrt22

The jeans no longer belong to you. The seller is obigated to pay the shipping if he wants them back.
