Credit Card Fraud/Theft

What is the name of your state? Texas

In Oct 2003 I applied for a GAP card and never received it. On Nov 7, I was incarcerated. I just got a call from a collection agency a few days ago telling me I owe them $700.00. NO WAY!! I didn't do this!! So I call the police department where I lived at the time(Georgia) and filed a police report and was told they couldn't investigate it because the statue of limitations have expired. But they did send me a copy of the report. Not that it will do alot of good!! So I don't know what to do. this is on my credit report and I have a collection agency hounding me even though I have requested paperwork to stateofficially that it is fraud. I am 99% sure i know who did it as she lived with me at the time. I emailed her and she said she disnt do it but she would help me pay for it. What's up with that?? If I had accrued this debt, I would pay it, and for principle reasons I am not paying it. I just need ot know what to do to get this off of my credit and to get teh collection agency off my back? Any help is appreciated. Thanks so much in advance.

1st - Hope your husband is safe, although that tends to be a relative term for sappers.

2. Don't wait on the CA to send you a fraud pack. Get their mailing address and send them a copy of the police report and a statement of fraud. Also contact the bank that issued the card and ask for a fraud pack. and fill that out too. It is going to sound silly, but your being incarcerated actually helps your case. I'm sure you have some kind of documentation of that with dates. That is evidence in your favor. If the charges started while you were incarcerated, you couldn't have been the one doing it.

3. Given the facts in your post -- I agree that your former room mate is probably the one that did it. But that isn't going to matter.

You will need to save copies of all the paperwork and plan on spending a lot of hair pulling time working it out. ACS should have someone familiar with the process. You might want to visit with them too.
