What is the name of your state? Texas In 2003 I obtained a Discover credit card for my mom to use. The account is in my name & she was an authorized user & had a card with her name on it. I got the card for her because she could not get a major credit card because my two brothers had ruined her credit. When the bills came in I never looked at them, just gave them to her & she made the payments. She had told me that she had let one of my brothers use the card on several occasions. In December 2005 she became very ill & I began taking care of her financial matters. I went online & obtained statements for the past two years. There were numerous charges that she said she did not make, that my brother must have used her credit card. There were two charges made on dates that my mom was in the hospital, in ICU. When she got out of the hospital the card was not in her purse, my brother had it in his wallet. My mom died on 04/14/06 and my brother has acknowledged to me that part of the balance on the account is his but that he won't have to pay it because the account is in my name & I'll "get stuck" with this, that her estate won't have to pay it because it wasn't in her name. Are there any criminal charges that I can file against him ( forgery, fraud, etc.) relating to this matter?What is the name of your state?

I believe you will be responsible for the charges on the card since the account is in your name. The credit card co. doesn't care who ran up the charges, they just want their money. I guess you could take your brother to court & sue him for the balance he owes. How much is owed on the card?
