Hello Everyone,

Thanks in advance for any advice:

I filed recently and will have a meeting of creditors in a couple of weeks. There is one card that I inadvertantly left off that and I have been using it since I have no $. Are the credit companies that I listed on my BK going to pull a credit report and see that I have another card still active? (It was for emergency items, car repair, home supplies, ect. ) I would prefer to keep this card and pay off this debt. What do you think?

Thanks,
Betsy

By continuing to use the card, as well as failing to list it in your filing, you are in violation of the bankruptcy laws. If the trustee finds out, you could have your bankruptcy dismissed.

I suggest you cease using it and seek advice from your attorney.

I don't know that the other creditors would kick up a fuss, but they could if they manage to pull your report and it is extremely up to date. CRA's get reports and are supposed to update every 30 days, but my credit report is nowhere near that current, from ANY of the 3 CRA's.

If I were you, I'd take Gottago's advice, you don't want to risk having your case dismissed.

Thanks,

I cannot afford to go to an attorney at this point....so, do I amend my statements and does that postpone my 341 meeting? Won't I get into trouble anyway for making charges after the BK filing????

No, you won't get into trouble, it happens all the time. People forget to put creditors on their forms, they just amend the paperwork. You might just be able to tell the trustee at the 341 that you need to add a creditor that you forgot. I doubt it would delay your 341.
