My mother over paid a credit card by sending in two checks. After realizing her mistake, she stopped payment on one of the checks. Two months later, she decided to close the account, so she called them. They sent her the amount of the check that she stopped payment on. I guess they were showing it as a credit even though it never passsed through the bank. Now, a year later, thet have realized that they sent her the refund in error and they want her to pay it back. Is she liable for this mistake?

Your mother should not have cashed the check. I am assuming she knew of their error when the check they sent arrived but she cashed it anyway. It is their money. They made a mistake and she didn't do the right thing by sending the money back. Your mother should give them the money back. I believe she would lose in small claims court. If this was my mother, I would be giving her this advice. People make mistakes every day. Put yourself in the other guys shoes?
