Pennsylvania is the state. I owe a medical debt and an attorney is collecting on it. There is no judgement or anything yet. I would like to pay the debt with my FSA account and the woman at the attorney's office stated that if i pay directly to the hospital they will still report it on my credit report because they won't receive the money for a long time. Legally, can they do that? The debt would be paid, with proof. So wouldn't that be false reporting? I'm sure she won't be honest with me about it.

It would depend on who actuslly owns the debt now. If the hospital owns the debt, payment to them would mean it is paid. If the debt was sold and the you sent the hospital the money, they would either send it back to you or possibly forward it to the owner of the debt where their receipt is what is of concern regarding reporting it on your credit report.

In any case it can be reported right now as delinquent since it is in fact delinquent
