creditor garnishes joint account

My husband had a judgement issued against him, my name does NOT appear on the judgement. The levied our joint checking account 2 days ago. If my name is not on the judgement, can they take my DIRECT DEPOST PAYCHECK?

what happens now? i know we need a lawyer, one finally called me back. I was told, unless I was notified they were going to do this to my husband, that they could not go into my joint account.

A joint account is just that. Money in common. Both you and your husband have the right to al of the funds. Therefore when the creditor got the judgment and froze your account, they can take it all (up to the judgment amount).

You might want to think about paying the bill or stopping you direct deposit.

I have every intention on paying the bill. But it's the weekend and I have checks wrote on that amount in the bank. Yes, i'm already on to stop direct deposits. I just wanted to believe what the lawyer said, so I am able to sleep. I'm sick over all of this.

I had the same thing happen to me, and found out they can take it, they don't have to give any kind of notice (this would allow you to remove the funds therefore they would accomplish nothing). Mine was on an old debt that I thought was paid, I have since worked out a plan to pay it off. Taught me to never take anything for granted, if you think something is paid, have documentation.
