creditor says we can not include debt

What is the name of your state? south carolina

my husband and i are filing ch7. we have a unsecured loan and the creditor says we can not include their debt in the bankruptcy because there was a clause in the paperwork we signed saying we cannot include this debt in a bankruptcy or any type of credit counseling. the creditor is also stating that they are going to garnish my husbands wages. if we do not include this debt in the ch7 then we are not complying with the bankruptcy laws. can we include this debt and can it get discharged. thanks for your help.

You can include it in bk. Also, wage garnishment isn't allowed in SC.
This has to be a local mom and pop operation.
