Is it illegal for an office admin employee of an investment brokerage branch to place stock trades while the branch broker is out of the office? What type of offense would this be known as & is it possible the broker wouldn't be knowledgeable of the activity?

Is the employee acting at the direction of the broker (i.e. the broker initiates the trade for the customer and the employee merely executes the broker's instructions) or is the employee taking the customer order and doing the trade himself/herself without direction from the broker? And in what state is the customer and brokerage house?

Georgia

The employee acts without direction from broker.
Does having the consent make a difference being outside of the office admin's position?

Yes, it is improper and if the brokerage knows it is happening and doesn't take steps to correct it, they can be in big trouble.
