crimminal background/discrimanation

What is the name of your state? Virginia
I have a friend who is trying to get a part time job and already has a full time job. Just looking for some added income.
My question: Is it considerated discrimanation if you filled out a employement application, got the interview,
did the criminal background check,were honest & upfront about your background before hand.
Which had happened over a year ago. It was a drug charge: felony
Called to find out the status of the position and were told that it would be a problem to consider you for the position based on the background.

Note: This is a retail position

Yes it is discrimination, but it is NOT illegal. An employer is under no obligation to hire anyone with a criminal past, especially for drugs.

Well what would it have made it illegal?
She was already told that it would'nt be a problem.

This was the district manager of a national chain of auto parts stores.
He should of told her up front.

If she wasn't hiring you based on your race, religion, gender etc. that would be illegal discrimination. It's prefectly okay to not hire you based on a criminal history. Heck, they can not hire you because they don't like the college you went to. And even if they said it wouldn't be a problem at one time they have the right to change their mind.

Nothing would have made it illegal.

Most employers like to wait for confirmation of a background check and confirmation form HR.

Nothing illegal has taken place and quit looking for something that you think or believe would have made it illegal. It didn't happen

And if she had lied about it and it was caught in the background check, what does she think would have happened?
