My grandson was awaiting a detention hearing at 1 PM in McKinney, TX (Collin Collin) the public defender lied and told him there was no one there to take him home. That is a lie. I was there since 11:30 AM. I am his grandmother whom he has been living with for one year.
The judge then appointed him, without advising me to represent my grandson in a court hearing set for Tuesday, July 19th. I was NOT told exactly what the hearing is for.
This attorney further blew me off, in front of the all the witnesses in the waiting room, stating he didn't have time because he had all those other people to see. HE would see me MOnday-he will be in court ALL day Monday and has alledgedly only promised a few minutes before the 9 AM hearing.

I've left him messages on the 14th (day of the hearing) and the 15th and he still refuses to call me back. He told me on the 14th in front of the same detention hearing waiting room that he would see me Monday the 18th, day be fore the court. I found out on the 15th that he will be in court the 15th and will ONLY have a few minutes before the 9 am hearing on the 19th. This is gross neglect and professional misconduct and misrepresentation with malice since he lied to my grandson.What is the name of your state (only U.S. law)?
Can I hire a new attorney for him to represent him for this hearing and fire the other one?

First: What are the circumstances under which the child is living with you?

Second: Yes, you can hire an attorney to represent him. Be aware that the attorney may have no obligation or inclination to share anything with you about the case...and that would be proper.

ETA: Is your grandson's name Christian? If you were referring to his religion, it was really unnecessary.

Where are the child's parents? Are you the legally recognized guardian for the child?

Don't tell me where he was living... tell me who is the legally recognized guardians of the child.

Because if one of those persons isn't you, you are no one to this case. The term is legal stranger. They are not allowed to release the child to a legal stranger.

Demanding a public defender's time is simply unreasonable under the conditions you describe. Put another way, when he has a few minutes with the child on Monday, how would you like it if someone demanded his time RIGHT NOW because their case was more important than your grandson's.

You can always pay for a private attorney. Depending upon the charge (which I noticed you never mentioned), it may be an excellent idea.

His name IS "Cristian". He is a Christian too.

His mother, my yongest daughter, passed away 11/21/2003. He lived with his stepfather and younger brother until the step father kicked him out July 5, 2010. He has lived with me since.

His stepfather NEVER tried nor began and filings for legal guardianship-he has a cousin that would have done it for FREE.
I have an attorney but was advised until his current charges are dealt with-to hold off-so I did.
His biological father abandoned him YEARS ago and has not been a part of his life at all. He did visit in 2005 but then never wrote,called, nothing.

He was arrested for drug possession. I know it's a BAD thing - I would never undermine that! But my grandson still has rights. His right to a legal coursel that doesn't LIE or deceive or misrepresetn ANYTHING! He told my grandson that "no one showed up to take you home" leaving him to believe I NEVER came! I was the FIRST PERSON THERE AT 11:30 AM.

My oldest daughter showed up whom didn't want him last year got to talk with the PERSON for at least 30 minutes - he didn't have TIME to talk to me.
To treat the person that had been caring for him like that - was rude and he did this in front of a roomful of witnesses - other parents awaiting their child's detention hearing!

Okay, I tried to be nice.

You are NOT a party to this criminal issue. The attorney is not ALLOWED to talk to you and shouldn't have talked to sis about the case.

And are you saying that the attorney DID talk to the sister but just didn't talk to you?

How much time do you think a PD has to devote to each case? Honestly, if you want the kind of legal counsel you describe, the only way is through a private attorney... that will charge you for every minute. If you wish to talk about the weather, they will be happy to oblige.
