What is the name of your state?
OH
I've read a few posts stating the have continuations on CS hearing and decision.
What are reasons for this?
I have a CS modification hearing tomorrow. I have not received anything on the past order in 8 months and am asking for increase for child care. I need this quickly as I am scraping by to afford everything on my own.
I have all paper work needed as proof of expenses. Can his attorney ask to continue and why?

Yes, his attorney can ask for one and the reasons could vary.

Have you been recieving support during these continuances? Also, how much more are you asking for child care. I live in Ohio and I know how much a judge will and will NOT agree on.
I have not had a continuation - yet, I am questioning if he can ask for one tomorrow at the hearing. Knowing how he doesn't want to pay anything, he and his attorney will do anything to get out of it.
Previous order is for $250/mo. plus he is to carry ins. policy.
Has not paid anything and dropped policy over a year ago.
Son was not in day care at the time of this order either.
I am not requesting a certain amount, I was allowing the judge to dictate that through the state guidelines and income assessments. Daycare is $490 a month and insurance $257. Theses are all costs not considered in the first amount.
We currently have joint custody and about the same income. I am hoping for half of these bills to be added.
I just fear them finding a reason to continue and paying these bills alone again fo another few months. It's getting tough.

Thanks for the help.
At least hopefully they can attach his wages tomorrow for some of it.
They weren't attached before. I am requesting it DEFINATELY be done this time.

Yes, I believe he can ask for one tomorrow. Unless I am mistaken, any prior order will remain in effect until a judge signs off on a new one (IF a judge does).

If he hasn't been paying AND dropped insurance, he is in contempt of a court order. Already things aren't looking good for him. If anything, the judge will factor in the amount that he wasn't paying via insurance coverage and factor that into a future order. He's already in arrears of his current order by not paying, so that is adding up as well -- in addition to interest.

What you should have done when he dropped coverage is filed the appropriate paperwork with the CSEA dealing with this. I believe you would've been instructed to fill out some sort of contempt form.

I hate to tell you, but it isn't going to get any better. He's obviously trying to avoid paying at any costs. Too bad it's currently biting him in the backside -- deeper and deeper each month.

Well, anyone can get a continuation if they DON'T BOTHER TO SHOW UP.
Next hearing, 2 more months.
I'm going to FREAK OUT!
By then, it will have been 10 months since I've even seen $1.
Not as bad as some have to go through, but it's taking it's toll on me.

He's not currently paying anything, and hasn't paid in 8 months yet you want to increase the order? Is there anything that leads you to believe that once the order is increased he will pay?

His wages were never attatched.
He worked as self-employed and under the table. I think he has at least kept his current job since Nov.
Plus, the past support was supposed to be paid DIRECTLY to me by wording on the court order and was not through CSEA. I couldn't report him or have his license revoked, nothing.
Yeah, Yeah! Stupid for me to agree to that at the time.
I had no way for them to enforce it.
Now with this new order, if I ever get it, I will make sure it's through CSEA and I will be the annoying B**** if it gets behind again.
I have every right to increase the order as well. My expenses strictly for my son have increased by appx. $650.00 per month since Nov.
He's not paying because he can't, he's not paying because he doesn't want to.

He can't rook the system, my son, and me forever.
Thank You.
