My attorney mentioned something about this today, but I think I might have misunderstood him, and would like some clarification if possible.

At a hearing in July 2008, I was given sole custody and placement of my son. Before CS was determined, son's mother asked for a de novo hearing. The hearing is in March. In the mean time, the CS issue was put on hold, because of the likelihood that the situation would be changing again (or so I thought).

If CS is ordered at the March hearing, can it be backdated to July when my son started living with me full time? There was no CS ordered prior to that.

What does the existing court order state regarding the issue of CS?

It will help if you type the exact wording of the order.

There is no mention of CS in the current order at all.

I have not filed, as I was told that since the situation would be changing, it would be better to wait and see what the final outcome would be. Son's mother had ten days to request a de novo hearing after the order was entered. My atty said we'd take care of the CS once that time period passed if she didn't ask for a new hearing.

She did. The court ordered a home study and a new hearing to follow after that.

The CS issue was put on the back burner while we dealt with the home study. The hearing was supposed to be this month, but got pushed back to March.
