My daughter is set to graduate with a Bachelor of Science in May, 2002 and I have been paying CS to her directly since she turned 18. I agreed to this as part of the original decree. I had gone through a corporate downsizing a couple years ago and had to miss about 5 months of payments while looking for new work. My daughter was very understanding, but my ex wasn't (even though my daughter was over 18 at the time and I was paying her directly).

My question is - the decree states that CS will be paid while the child is enrolled as a full time student in an accredited college or university. Would the CS still be payable for the 3 months during the summer when she isn't enrolled full time or even attending classes? If the CS wouldn't have been due, then I actually overpaid the CS that was considered overdue. Oh, this is in Texas.

in most states you are required to continue support through the summer months, even if child is not attending school.
