Person on probation gets arrested. Bond set and is bonded out. Private attorney hired. About two months later while at court he is arrested again for viol/prob. He is not bonded out on that case per advice of lawyer. He will not take violation case so court gives pub. def. special attorney section that case. Sentencing is on Oct. 10. He stayed at jail until then from July 20. End result his violation charges were dropped (was sitting in jail for because it was too high to pay) but his new charge from May was imposed and sentenced to 15 months with 3 yrs. probation. My question is he was held there on advice from the paid attorney and pub. def. The paid attorney for which his case was the one sentenced on was not at the sentencing, final appearance. He assured me that although he was bonded out he would argue for the credit of the good time served. the pub. def. (violation charges) was in court and his cases were voided. How does one get credit for the days he waited in court? Can an outside person request this? Is it better from the lawyer? Thank you
