I have a question about a plea bargain my fiance took on January 7th. The prosecutors, after 7 yrs. offered him a plea, a 5 with a 3... He was told by the social worker that this is an illegal plea... He was told that the bottom number cannot be more than half of the top number.. So, a 5 with a 2 and a half is legal. I know nothing about New Jersey law, or really any state laws, so I am hoping someone can answer my question.. Thanks a lot :)

Yet another reason why social workers should be packed up and carried off to Mars.

Sounds like your sweetie is stuck with this. But, just in case the SW is right (a ghastly thought) axe the lawyer about filing for post conviction relief on the basis of an illegal sentence.

Or if he is in jail on an illegal sentence, have him file a motion for a writ of habeas corpus.

Have his lawyer do all this stuff.
