Custody and last name change

What is the name of your state? Florida

My ex- girlfriend got preganant and soon after we broke up. She decided for no reason to not let me see the child and she didn't even put my name on the birth certificate. We did a paternity test and after I was able to see my child once a while. My child is now 2 years old, and I decided to took her to court because I wanted to see my child more often and give use to my parental rights. My goal is to have joint custody of my child, and I agree that the primary residency be with his mother. I am the father and we never got married, we are both capable to take care of our son. Would the court give us equal rights, or the mother gets priority? She recently decided that she doesn't want me to see the child at all. Is there anything I can do to visit my child while the process in court takes place? she also gave him her last name, but I would like to either change his last name to mine, or have both my ex - girlfriends last name and mine in his birth certificate, is there any way I can have this done after the custody problems get resolved?

You will have to start a custody/visitation suit against your ex girlfriend. UNless the DNA test was recognized by the courts and you were legally declared the father she does not have to let you see the child. As such you are not obligated to help support this child.

As far asa the name change You will have to wait for one of the local attorneys to answer that one.

A: We don't know you and we don't know her, so no one here can say.

A: Yes, in your lawsuit, ask for temporary visitation orders from the judge.

A: I have never heard of a contested name change for a minor but there may be such a thing in your state. Make it a part of your current lawsuit and see what happens.
