custody and support

My ex has been very irrisponsible in paying child support
and his part of medical expenses. He is now suing me for
custody of our 14 yr old son. Will his lack of resposibilty
be a factor in the judges dicision? My son wants to live with his dad because dad is more fun and doesn't have the rules that I have. We all live in the same town, less than
10 minutes from each other. So he see's his dad very often.
I am very afriad that he doesn't have enough supervision when he's in his dad's care. What should I do? Fight it or allow it?

You alone have to decide if allowing your son to stay with his father is right or wrong. I can say that if you do not want him to go that if his father has been ordered to pay support and is in arrears that his chances of getting custody are slim. You can also bring up in court the supervision problem at dad's as a defense against son going to dad's.
