Hi, my name is Craig. I am having troubles with my ex-girlfriend about our kids. My ex was arrested for domestic battery this past week. While custody she stated that she was going to kill herself. So while in custody she was locked up in the psychiatic ward in the county jail. 24 hours later she is released and now I can not see my kids because she does not want me to. I used to pick the kids up from school and now the daycare workers will not let me pick them up anymore. She has full custody of the kids and it seems that I am a father with no rights. I pay half for the schooling and pay all of there insurance. What rights do I have as a concerned father? I would like to get at least joint custody with the maother if possible or full custody. I have a really good job and I am financially able to take care of my kids on my own. Could you please advise what can be done. Mean while my relationship with my kids maybe fading because the mother is tellin gthe kids that they will never see me again.

I thank you in advance for any help that you can give me.

My response:

Now is the time to see an attorney. You need to file for an order that will determine custody and visitation arrangements. You may, based upon her history as you explain it, obtain full, physical, custody, and she may obtain monitored visitation. Even if things get better between you in the interim, you need to have court orders to "back you up" for the future. Exercising your rights in this matter and manner should have been obvious to you.
