Custody change due to crminal act?

What is the name of your state? GA

My wife and I have joint and legal physical custody. I have them 1 week she has them the next week. If she were to go to jail for a criminal act would this have any effect on custody or might a change be justified due to that fact.

Thanks for any input

She might have comitted ID theft to help a person out in his divorce case and pretended to be his wife and changed her information on a credit card and had the mailing sent to his house.

Depending on the circumstances that might not be identity theft....particularly if it was a joint card and he authorized her to change the address for him.

Absolutely, how is she suppose to take care of them while in jail? A change of circumstance would result only after the mother is convicted and sentenced.

No the card was only in the wife's name. It was her personal card and the only changes to it was to change her last name when she got married. A police report has been filed and a detective has been assigned her case.
Also a report has been filed with the ID Theft agency.

What else is there to say? IF and when Mom is convicted of a crime and sentenced to jail, you'd be able to file for full custody. That was your question and that was the answer given to you more than once.

If you have questions as to her criminal actions- post them on Criminal Law board.

Thanks, but what if he gets convicted but doesn't do time for it and gets fined and has a felony on his record.

"he"? Your post was about an Xwife who you think committed identity fraud...who is the "he" you refer to?

If a person is convicted of a felony but does not serve time and has a felony on their record- It would depend on the type of felony and whether or not a family court judge felt it had anything to do with how they parent their children.

i was left off the s. She commited ID Theft but what if sheonly gets a fine

and then maybe goes to jail but gets put on probation?

Then a judge will have to decide if she is a danger to the child.

Well I'd buy the "I left off the 's' in she"...BUT same post says "his" and that is more than one letter away from "her" :rolleyes:

co-worker and OP have opposite sex Xs, opposite criminal situations, yet can answer responses interchangably? :eek: Hmmmmmm Makes me wonder if ALL involved are cousins :cool:
