Minn. My sister is going through a custody/support battle. Her ex boyfriend is saying that since she is a smoker this will get him sole custody of their child. She is a great Mom and has always been there for her kids. She works full time while he does not but insists that their daughter go to daycare at her expense. Would she lose the custody of their child on the basis of smoking cigarettes?

If that is the only thing he has on her, probably not. But I highly suggest that she smoke outdoors and not in the home. Not only for her case, but for the child(ren).

My husbands ex is a major chain-smoker...and that didn't give us any leverage. But because of her selfishly smoking throughout her pregnancy and till the present time, her daughter has had many health problems..low birth weight, asma, etc. I personally think it should be considered child abuse to smoke in the vicinity of a child.

Was she a smoker when they started dating?

Was she a smoker when he decided to have children w/her?

If so, then it wasn't a problem for him then -- not big enough to keep him from bringing children into the situation.

Therefore, it's pretty hard for him to raise that as a big issues and keep a straight face NOW that they have a custody issue at hand.
