I am currently going through a situation involving custody. We have joint custody, in which, my ex-wife is the custodial parent. (We were married and divorced in NJ) Now, in conversations with other in this type of situation, I have come to the conclusion that NJ is more difficult that other states when it comes to mens rights. Here is the problem. My son, (11 yrs. old) has been asking to come and live with me for about 9 mos now. And as of recent, he is really being persistant. He is giving his mother a hard time, refuses to go to school etc.. He assures me it is really what he wants because I've given him every possible quesiton I could and the bottom line is, he wants to be with me.
My question is, should I pursue this through the court, is he of age to have a say in where he lives. Will the court consider his feeling in this situation?
