Custody if unmarried?

Ok, here is my question....I have a three month old son, his father and I live together in Illinois, we are not married. And his father is listed on his B/C. We split all expenses 50-50, with the exeption of medical insurance that I take care of. What I am wondering.....is custody implied for either of us, or does there have to be a court order for custody. We are together with no plans of seperating, but I am just wondering where I stand while we are together and what would happen if we ever did split up. Thanks for any help.

Because the fathers name is on the B/C you both have the same legal rights to the child in the event that you should break up. You would have to pursue custody through the courts just as if the child were born in a marriage.
