I try to read alot of posts to learn, and again, a response by jslopez got me thinking.
You mention that support being unpaid and behind may have bearing in custody issues. Does the amount or length of time of nonpayment have weight?
I receive CS directly (yes, I already filed modification and for wage garnishment), it's been going on 10 months since I've seen a dime. I filed the motion for contempt (motion on Apr.28, CS hearing on May 3).
I had also filed for cust. mod. and evaluation request a few months ago, I received this, will these CS issues and the contempt factor in on the custody issues?
Also, on May 3, hopefully a reasonable CS order is in place, what about the "Court Ordered" Child support? That is a seperate order and must be dealt with through custody mod., not CS mod., they can't change it. Does he still have to pay the court order amount plus the new child support amount until the order is modified? Should I accept it if he actually pays?
