Custody of grandchild

We live in Alabama, and I went to court last year and got custody of my grandchild who is 21 months old now. My daughter who is the mother did not show up in court but the father did and he singed custody to me.
My daughter is 17 and she got married at 16 which I did not sign for her. The boy she married got his mother to take them to Ga to get married. In Ga they say if a girl is pregnant she can marry the babys father without a parent having to sign but at the time they got married she already had the baby so I don't understand how they done that. She ran off and left them both and thats when I got custody. I have not got any childsupport or help from either one of them and they are not in my grandchilds life now. How can can I full custody of my grandchild so they can not come back and take her away?

In court the father was told that he could got come and take her out of my house unless I told him he could but I want to make sure of this. Is there something else I need to do about keeping custody? The custody I have now, is it full or temp? I don't understand all this. Can you help me?

What is the exact wording of your custody order? It should say on there if it is temp or permanant.

It sounds like you have guardianship of your grandchild, signed by the father and by default by mom. There are several way to proceed. You may apply for child support and medical through the courts or through the welfare department based on your guardianship. Of you can wait and terminate their parental rights by virtue of abandonment but not knowing what your orders say, it is possible the child is already permenantly placed with you?

It says Legal custody of said child divested from the father and mother and transferred to Me physical custody shall remain with Me. So is it temp or what? It just says physical custody... Do I need a lawyer?

It sounds to me like you already have "full custody". Therefore, neither one of them can take the child without going back to court and winning custody themselves.

However, just to reassure yourself, go and get a consult with a local attorney. The attorney can explain to you what your orders mean.

Need alot more info....what county are you in?

Did you intervene in the divorce or did you through a juvenille judge (familly court)?

Did DHR have any involvement?

Did the court declare the child to be "dependent" and then give you custody?

I live in Lee county in Alabama and no I didn't intervene in the divorce cause there was not one. They are still married to each other but he is living with a girl and she may be pregnant now by him and my daughter is off doing what ever she wants. I petition the court for custody and her daddy went with me and thats when he signed custody over to me. My daughter didn't even come to court. DHR has never been involved in this and never will be I pray. I get no childsupport or anything from them. I just want my grandchild to be safe and healthy. I am worried that they will come and try to take her away to hurt me. ......

Since the father signed over custody and wants nothing to do with the child..ask him if he will sign over his parental rights. Then you don't have to worry about the father..just the mother. Ask the court (if you go) if they can terminate your daughters parental rights too. If both rights are terminated then you can adopt and then the child is yours. It seems simply enough, don't it.
