I live in Tenneessee. My girlfriend has a son born when she was 19, 4 years ago. At the time she gave temporary custody of the child to her father for insurance purposes. Now he holds the childs custody over her head by saying he will take the child if she does something he does not like. She has a steady juob, but lives at home with her father. Wht are her rights her? Can he simply refuse to give custody back to her? She has no legal problems.

Doesn't the temporary custody order specify the term of the order (how long the grandfather was to have temporary custody and the reason he was given temp custody in the first place?) She hasn't terminated her parental rights, has she? If she has been taking care of her child, and has no reason to leave custody with her father, why hasn't she simply revoked the custody or filed with the court to do so? It would likely be in her best interest to do that sooner than later. The longer she leaves custody with her father, the more difficult it may be to revoke the custody from him later.
