Once again, thank you for all of the helpful advice!

Now the mediation has fallen through. They continue to call me and my ex, saying there's no mediators available. So ex is fed up, and just wants us to talk things out. He has already questioned me if I am asking for child support and custody, which I am asking for both, regardless of us being not married.

My question now is, will I receive any kind of support - I'm asking because I make more money than him -- or would I have to pay child support to him?

It'll depend on income of both parties, whatever expenses(health insurance/daycare/etc) for the child are incurred, as well as the # of overnights(please don't use CS as a reason in your head to reduce the visitation time Dad has) just for a start.

If you get full physical custody, as opposed to shared custody (each of you have the kids more than 35% of the time) dad will have to pay you his percentage of the combined total child support, which is based on both your incomes. If it were shared custody, you could very well pay him depending on the number of overnights per year he has the child.

I am only questioning the support/custody because it was suggested to me. I am not bitter or feel the need to manipulate the visitation between Dad and the kids at all. I just wonder if all of this legal stuff is actually needed, or is this something that me and my ex can work out between us? Or would it be better to work out something, have it "legalized" in some form, and go from there?
