What are the chances of my SIL getting my nephew back?

My Brother and SIL are cocaine addicts. My brother is serving prison time till January and my SIL is in Rehab for the second time. She is very good at manipulation and lying and is a pathilogical lier. Even though she is in rehab for the second time, what are the chances that Child Protective Services and/ or Texas courts will giver her kids back even if she is living in a halfway house?

Right now I am trying to let texas run its course in hopes that they terminate the parental rights. But, do you think I should have my own attorney as well? My niece is 4 and my nephew is 7 months old. I have had them since my nephew was born.

Please advise. I am sooo confused and CPS won't tell me anything even though I have temporary custody thru the courts. They won't even answer my questions. I want complete custody of these children.

And nobody can tell you what the chances are because nobody knows what the case plan says. And you truthfully do not have any more right than any one else to custody of them at this point because CFS has custody currently and they are letting the kids stay with you. Texas has to run their course. An attorney cannot do anything to force the issue. The prosecutor/children's services is in control.

If CPS is involved, you most likely have temporary GUARDIANSHIP, not custody. The STATE almost always retains custody if the child is placed with someone other then a parent. In Texas, CPS is going to do everything possible to return the children to a natural parent. If your SIL and/or brother successfully complete whatever plan it is CPS has outlined, the children will be returned, albeit under strict supervision from the state for a while.
