Hello Everyone!

I have a quick question, My husband has not seen his son for over a year now and believe it or not he is still looking. Her family refuses to tell him her whereabouts.
My questions is, if and when he finds her can he sue for custody? We live in Jersey City, New Jersey but the court ordered child support is in Passaic New Jersey.

File a petition in the original court for custody now, based on abduction and denied visitation. Write to the family and inform them that you are petitioning for sole custody and bringing criminal charges against her. Also that if she does not 'surface' in 28 days the court will rule in your favor and you will get a default judgement and she will legally lose custody of the child.

Bet you a dollar she appears ..
