I have sole custody of my children. My ex has been granted visitations. My ex told my kids she ( and her new husband ) were going to buy dirt bikes for my boys to ride while in her care. I don't think these things are safe, otherwise, I would've got them dirt bikes myself. My question is.....

What say do I have ( given I have sole custody ) when my boys are in her care? Do I have the right to say what they can't do while with her? They're under my health care insurance.

Thanks!

Legal Custody (as in Joint legal custody) is defined as having the right to make major decision for child such as education, health care and religion.

Physical Custody (as in Joint physical custody) is the parent who has child the majority of time (joint - both)

Sole Custody as defined by Maryland law states parent has majority physical time with child (other parent-visitation) and "major" decisions concerning child's life

It's my interpretation that the "dirt bike" issue is not a major decision concerning the child's life

She's allowed to do what she chooses when she has the kids. Some parents think dirt bikes are dangerous and some don't. You don't get to dictate how she parents them on her time.

What you can do, is educate your sons on safety- helmets, proper gear, having an adult present in case of emergency, etc.

Good point, casa. And if SHE refuses to provide helmets - buy them yourself. Well worth it.
