My parents entered an agreement where my father would have custody, but my mother would have visitation rights but the freedom to apply for custody later. Does a CA court look at this as if custody was "awarded" to my father or that my mother is "unfit" to have custody? The terms of the agreement were stipulated in an "ancillary order" from a foreign court in the country where my parents were divorced. My father has since moved to CA and is frustrating my mother's access to her children.
