does the lenth of time a child resides with his/her parent qualify that parent custodial rights in the eye of the courts of North Carolina ? Can a non custodial parent remove a child from the home of a custodial parent even though there is no legal agreement?

Unless there is a court order specifying a parent as physical custodian you both have the same rights by law to have access to the child.

That is why it is stressed to posters on these threads to be leary of visitations during seperation (pre custody order) As the NCP can take the child and not return him/her as promised and you dont have a whole lot of options other then a lengthy, costly custody battle as a result.
