I live in New Jersey with my husband and 3 children. I'm a stay at home mom with no income. I've been home for 8 years now. I beleive my husband wants out. I thinking about taking the children to Virginia this summer so we can stay with my mother. I want to make sure I have custody of my children before I go. Right now there is no way I can afford a place to live and child care (full time for 1) on my own. I realize that he is responsible for support for the children and maybe myself but I also know that there is no way he could provide for that and our current home and other bills. Also would it be possible for me to allow my mother temporary custody while I get set up in Virgiania.

Why don't you wait until you know he wants out for sure? Or you can start filing paperwork now if you're considering separating. You'd have to petition the court for a temporary custody order and I believe a pende lite application which would make him pay something while the paperwork is being processed.

If you are currently married, living in same home..you already have custody,as does he. You can go to mom's for summer for vacation, as long as you are not planning to stay perm & not tell your husband until after the fact. You can't give custody to anyone, even temp because you are not the sole custodian...and if kids should need to stay with your mom while you organize..there is no reason to sive temp custody. She is grandma but, if you will not be close you may want to make provisions giving your mom authority for medical treatment,school info, etc...all can be done with letters,in person on your own. Not sure I understand why you can not get set up while still keeping your children, maybe just with your mom's help...like babysitting while you job hunt. Where will you be staying while kids with your mom? I too think you should wait until husband makes a move...even in no fault states, even judges are human...let him file first,make first move. If he opts out, get a lawyer and most will work a temp. custody/support agreement to use while getting perm one in place. Good Luck.
