Two months ago, I've asked my husband for 7 years to move out of my home, after supporting him for so long I finally got tired and requested that he leaves. On October 26 while I was at work he called our township police and file child abuse charges on me so that he can take my daughter out of house. He has manage to take her out of school and put her in a public school somewhere else, and moved into a room. 3 weeks ago I file all papers and now I am waiting for a court hearing to get my daughter back home where she belongs. My family and I have not been able to speak with her or see her. The holidays has been a nightmare, christmas came and went and he still refuses to allow me to see her. He states that he was advised by his lawyer not to allow me to see her.

After much search we found where they are living but I have been advise that 2 wrong does not make 1 right, which mean I can not go in and take her, I will have to wait for my day at court.
During all this time, he has manage to convice my daughter that I abused her and caused bodily harm, I am not worry about this becuase its all lies however I am worry about my daughters mental state. How long does it take to get a court date?? I miss my daughter so much I can't talk to her the phone because he changed his cell phone number. I feel like I am fighter for air.

I wish I had some suggestions for you. But I honestly don't. I just wanted to tell you good luck, and hang in there.
And that I am very sorry for your situation. It just goes to show, no matter how bad our situations get, there is always someone out there who has it worse.


Hopefully, this post will at least keep yours up so someone who actually has some answers for you will read and answer it.....

I too can not offer legal advise. However I'm curious as to your outcome on the abuse charges. I asked my husband to leave Oct. 30th of 99 and did not file for divorce until Dec. 10th of that year. I can't recall but I do believe that he had called CPS on me before I filed. I called the lady back and was in the process of setting up a time for her to come to my house. She stated she couldn't tell me who made the report but read the report to me. I told her the situation and explained that there was no need to tell me who reported it because I knew who it was. I never heard from the woman again. Have you spoken to child welfare yet? They may be able to help you.

First need to give more info on child abuse charges...were you charged?? Is there a court date, did CPS contact you,etc...or are you just going by what ex tells you? Consider a lawyer if you do not have one, giventhe issues. Said you filed papers..for what?? do you have a court date?

I was not charge with abuse no court paper ever arrived and I have yet to get to court to try and get my daughter back. I do have a lawyer and yes I am going by what my ex states which leave me to believe that he is causing more harm on my daughter with his lies then her mental state of mind. The waiting for the court date is killing me, I've lost so much sleep and weight, I don't know if she is okay again there are no phone numbers for me to reach her.
