What is the name of your state? California. The case is filed in New York in USDC of the Eastern District.
I am in a lawsuit with well known cyberstalker David D'Amato based on a blog I publish exposing his prior federal convictions, and current stalking type activities.
The case can be read about in a blog I put up to address it, that is at http://thecourtofpublicopinionandlaw.blogspot.com but a summary is D'Amato is convicted of computer abuse (18 USC 1030) based on him harassing a 17 year old kid because the child refused to tie himself down shirtless to be tickle tortured and aired on the internet. This was in 2001.
I had a business relationship with him starting in 1997. I produced films for him until I discovered he was airing them on a website. I did not know his history at this time, because during the entire course of our business relationship he was pretending to be a 20-something aged female, once I started investigating his posting of videos, I uncovered a wealth of information relating to his conviction and current cyberstalking activities. He is suing me (and Google, Goddaddy.com, and others) in USDC Eastern District of New York although I live in California (pleadings can be read on the Court of Public Opinion and Law blog I list above) for $5 million dollars, claiming defamation. The fact is that everything aid in the blog is 100% true, and there is extensive electronic evidence to support it, along with the records of the United States Attorney in Boston who is co-operative with me, and advised me to file a "Touhy" request and provided me with relevent sections.
I am asking to see if you would consider taking this as a pro bono, or in the alternative a cross-complaint contengency against D'Amato. David D'Amato is a millionaire based on "daddy's money." He is an arrogant person who thinks that he can do anything to anybody he pleases. He has tried everything to get me to take the blog off the air, including illegally obtaining my cellphone bill and blasting obscene messages to all whom I have called (ranging from late 2005 to early 2006), and posting a slanderous site on me (http://www.davidstarr.nl) which unlike mine, just contains anti-semetic material and rather stupid name-calling content, but outside US Jurisdiction. He put that up for the sole purpose of hoping to trade off (I take mine down if you take yours down), but I have refused - once I refused, he filed his suit to intimidate several people who were airing my information ... including Google. He succeeded in some areas, and flatly failed in others - especially against Google, they victoriously got out of the case without giving in to D'Amato in any way, the material is still aired on Google under the First Amendment protections.
