Hi everyone.

Due to my ex husbands excessive drinking I filed a motion to have him not drink in the childrens presence. It was ordered and put into effect Jan 26 of this year. The exact wording is "The Father(name here) will not ingest any alcoholic beverages 24 hours before excercising visitation and during his visitation with the children"
Just today out of the blue my 5yo tells me his daddy has been "drinking beer" and that he took both kids(they walked ex has 2 DUI's pending and 2 driving on revoked) to the liquor store with him to buy it. I confirmed this with my 13yo who was hesitant to tell me at first but then did. I called my ex who, as expected, gave me the "whatever" and "think what you want to" answers.

My question is what do I do now? Do I call the police, file papers? Will anyone even take a 5 and 13yo's word over an adults? Any help would be much appreciated. Thank You!

I would usually say not to involve the children, but clearly there is an existing order forbidding him from drinking. File a motion of contempt, your children are better off with less visits than they are escorting Dad to the liquor store. With his history, you could request supervised visits.
